La batalla jurídica contra la amnistía es muy trascendente. No es algo baladí. Es necesario defender el Estado de Derecho y la separación de poderes. No es la primera vez que el poder político utiliza el ordenamiento legal de una democracia para imponer leyes que atentan contra la Constitución. Ha sucedido otras veces y volverá a suceder. No hay que sorprenderse porque existan juristas de cámara que lo validen. A la hora de plantearme si es posible evitar este tipo de procesos, el catedrático alemán Bernd Rüthers escribió que es necesario contar con «una generación de juristas que se sienta vinculada al orden democrático de libertades, que sepa de la dimensión política de su profesión y que ponga sus herramientas teóricas al servicio de la Constitución y para su defensa» (Derecho degenerado. Marcial Pons, 2016, pág. 49). Tras las últimas actuaciones del Tribunal Constitucional, como sucede con los ERE, nada podemos esperar de quienes están perpetrando una escandalosa mutación constitucional. Una vez más nos encontramos con el uso alternativo del Derecho para ponerlo al servicio de los intereses partidistas del poder político.
